1. General Terms & conditions of business

The following terms and conditions refer to SH Design Malvern and its relationship with its clients and potential clients.

Quotes & Prices

  • Please note any stated timescale is reliant upon the client providing all required information/images/copy within the time set out at the start of the project.

  • All quotes are valid for 30 days from the date of submission.

Methods

  • Should the Client supply text, artwork or images, SH Design Malvern is not obliged to edit, check or guarantee the correctness thereof in any way whatsoever, and the end product shall be made at the entire risk of the Client.

  • Please double/triple check proofs before they are sent to print. SH Design Malvern will not be held responsible for any mistakes, typos or cost of reprinting.

  • SH Design Malvern shall be indemnified by the Client in respect of any claims, costs and expenses arising out of any libellous matter or any infringement of copyright, patent design or any other proprietary or personal rights contained in any material supplied by the Client. The indemnity shall extend to any amounts paid on a lawyer's advice in settlement of any claim.

  • Drafts and/or initial design choices and any copyright subsisting therein shall remain the property of the SH Design Malvern unless otherwise agreed in writing with the Client.

Invoices & Payment 

  • SH Design Malvern requires a deposit of at least 50% of the quote total prior to instigating work, particularly but not limited to the following situations: new clients; clients with a poor payment history; large, lengthy or complex projects.

  • Where a deposit is required, the final balance shall be due upon completion of the work, unless otherwise agreed in writing in advance.

  • The remaining 50% payment must be made no more than 14 days after date of invoice unless otherwise agreed in writing in advance.

  • All work remains copyrighted to SH Design Malvern until settlement of relevant fee, where the finalised file’s copyright will transfer to the client.

  • All work completed after project inception will be billed as it is completed and must be paid within 14 days.

  • When payment is overdue, SH Design Malvern may suspend work, service and/or delivery without notice and without prejudice to any other legal remedy until due payment has been made. Furthermore, any work started but incomplete may be suspended and payment therefore becomes immediately due and payable, notwithstanding anything expressed herein, and any monies in respect of.


2. Privacy policy / GDPR

This Privacy Policy describes how and when SH Design Malvern collect, use, and share information when you contact them or an item is purchased or otherwise use services through Etsy.com or its related sites and services.

Information I Collect

  • To fulfil your design needs you must provide me with certain information, such as your name, email address, postal address and the details of the design work that you require. You may also choose to provide me with additional personal information (for a custom order of a print, for example), if you contact me directly.

Why I Need Your Information & How I Use It

I rely on a number of legal bases to collect, use, and share your information, including:

  • As needed to provide my services, such as when I use your information to contact you, fulfil your order, to settle disputes, or to provide customer support;

  • If necessary to comply with a legal obligation or court order or in connection with a legal claim, such as retaining information about design work taking place if required by tax law.

  • As necessary for the purpose of my legitimate interests, if those legitimate interests are not overridden by your rights or interests, such as 1) providing and improving my services. I use your information to provide the services you requested and in my legitimate interest to improve my services.

Information Sharing & Disclosure

Information about my customers is important to my business. I share your personal information for very limited reasons and in limited circumstances, as follows:

  • Service providers. I engage certain trusted third parties to perform functions and provide services to my shop, such as delivery companies. I will share your personal information with these third parties, but only to the extent necessary to perform these services.

  • Compliance with laws. I may collect, use, retain, and share your information if I have a good faith belief that it is reasonably necessary to: (a) respond to legal process or to government requests; (b) enforce my agreements, terms and policies; (c) prevent, investigate, and address fraud and other illegal activity, security, or technical issues; or (d) protect the rights, property, and safety of my customers, or others.

Data Retention

  • I retain your personal information only for as long as necessary to provide you with my services and as described in my Privacy Policy. However, I may also be required to retain this information to comply with my legal and regulatory obligations, to resolve disputes, and to enforce my agreements. I generally keep your data for the following time period: 5 years.

Your Rights

If you reside in certain territories, including the EU, you have a number of rights in relation to your personal information. While some of these rights apply generally, certain rights apply only in certain limited cases. I describe these rights below:

  • Access. You may have the right to access and receive a copy of the personal information I hold about you by contacting me using the contact information below.

  • Change, restrict, delete. You may also have rights to change, restrict my use of, or delete your personal information. Absent exceptional circumstances (like where I am required to store data for legal reasons) I will generally delete your personal information upon request.

  • Object. You can object to (i) my processing of some of your information based on my legitimate interests and (ii) receiving marketing messages from me after providing your express consent to receive them. In such cases, I will delete your personal information unless I have compelling and legitimate grounds to continue using that information or if it is needed for legal reasons.

  • Complain. If you reside in the EU and wish to raise a concern about my use of your information (and without prejudice to any other rights you may have), you have the right to do so with your local data protection authority.
